STATE BODIES WHERE YOU CAN FILE AN APPLICATION FOR FINANCIAL SUPPORT


State financial support can be applied for with the Ministry of Justice of the Czech Republic, Compensations department, Praha 2, Vyšehradská 16, 128 10. The application form is available online on  www.justice.cz under the link “Ministry of Justice” and then under the headword “compensation”.
Apart from entitlement to damages from the perpetrator the crime victim is also entitled to apply for a financial support from the state under the Act N.45 / 2013 Coll.
The purpose of state financial support is a provision of prompt financial support to the injured parties including survivors in case of severe violent crimes so that their impaired social situation can be overcome. This support is provided regardless of whether charges against the perpetrator of a criminal offence have been raised or not.
It is possible to apply for financial support from the state within two years from the day the criminal offence was committed, or when the injured party learned about the criminal offence, at the latest, but no more than 5 years after the criminal offence was committed. Condition to granting this support is the fact that based on the outcome of criminal proceedings there are no doubts that a criminal offence was committed, as a result of which the injured party incurred a serious harm.
If the criminal offence resulted in death, the right to financial support belongs to the survivor, in case he/she was a parent, spouse, registered partner, child or sibling of the deceased and he/she shared a household with them at the time of his/her death; or a person to whom the deceased provided for or was obligated to provide maintenance.
In order to qualify for financial support from the state you must meet the following:

  • to report the criminal offence without delay to the Police of the Czech Republic,
  • give consent to the prosecution of the perpetrator,
  • submit a written application for the grant of financial support.

The Ministry of Justice will grant the financial support within three months after the submission of the application and required documents, which can be requested in addition as required, or they will inform the applicant of the reasons for which they were unable to grant the support.

If the Ministry of Justice satisfies the application, compensation will be paid out within three months from the submission of the application. This is possible either in a lump sum of CZK 10,000 (CZK 50,000 in case of aggravated bodily injury) – the amount of the entitlement does not need to be documented in these cases, or in the amount corresponding the real entitlement of the injured party, but maximally to the amount of CZK 200,000 (in such case it is necessary to document all confirmations of the lost earnings, expenses and costs incurred in relation to the consequences of the criminal offence).

In case of a criminal offence which resulted in death, a lump sum of CZK 200,000 is provided (CZK 175,000 in case of siblings). If there are more survivors, a financial support in the maximum amount of CZK 600,000 will be provided.
